F.A.C.T. Help Needed: 2003 Constitutional Court Challenge

In 2003, F.A.C.T. participated with a number of other Canadian groups as a co-plantiff in a constitutional challenge on certain aspects of the Canadian Divorce Act as implemented by the federal Department of Justice (mostly via Parliament). You can read, in PDF format, the statements of claim with respect to the "best interests of the child" test, and of the child support guidelines. There are clearly sections of the Act, and of the implementation, that clearly violate the rights of Canadian children and their parents. In addition, by creating a contentious and adversarial procedure, the legislation acts to drain resources from the father, mother and children for the benefit solely of the "divorce industry" that lives off of, and fuels, a conflict.

Of course, the federal Courts are supposed to be independent, but the judges are appointed and promoted by the federal Minister of Justice and sit in courthouses built by the federal Department of Justice. The Crown Attorneys are employees of the federal Department of Justice. Not unsurprisingly, the Courts and the Crown have been working hard to get this action turfed.

At the current time, the Court has stated that F.A.C.T. requires a "vast membership" of Canadian residents in order to proceed under one of its strictures. What "vast" is, no-one knows. Believe it or not, it appears that the Court actually questions whether there is enough damage out there to have impacted a "vast" number of Canadians! We know there is. This decision is being appealed now, and we expect that will be heard in 2004. We need your help now.

What we do know is that we need you to sign up a Friend of F.A.C.T. in this matter so that the claim can proceed up through the court system. We need Canadian residents who have been negatively impacted by unfair divorce laws to join in -- whether impacted directly, being impacted now, or having been impacted as the result of the divorce or separation of a family member, friend, employee, coworker, or any one else. To that end, we have created a form to allow you, your family, friends, coworkers, and every one else to join with us in pushing this case into the courts. Please join in right away.
